Last week, the Pennsylvania Department of Health (“DOH”) made available a Safe Harbor Letter, which enables parents and guardians of sick children to treat with medical marijuana. Applicants will have to complete a background check and obtain a letter from a physician providing information about the child’s medical condition. Only certain medical conditions qualify, such as cancer, epilepsy, multiple sclerosis and others.

The Safe Harbor Letter is only the first of a wave of issues to be addressed by the DOH in the coming months. Temporary regulations addressing everything from doctor registration, quality control, and permit applications are expected to be promulgated before the end of the year.
